What are the penalties for deliberate credit card fraud?

If someone were to steal someone’s credit card information without them knowing and then later attempt to charge purchases on it and the owner of the credit card filed a claim with their credit-issuing bank and the person making the false purchases was identified what would could he/she be sentenced with?

If I decide not to prosecute someone for credit card fraud will my credit be ruined?

Two people used my credit cards without my consent. I filed a police report and they were arrested and jailed for 7 weeks. Their hearing is on Jan. 14 and I want to drop the charges even though they already confessed to everything. I was told that as long as I filed a police report I was OK. If I drop the charges now will my credit be ruined or is it still fraud?
